FISA was written to give the POTUS the authority to wiretap. And he can wiretap anyone he likes so long as he gets a warrant within 72 hours. The process is quick and streamlined. Bush had no excuse not to use it. Unless he was wiretapping political foes in the US and didn't want anyone to know about it.

My guess is that Bush was not tapping Al Qaida at all, but democrats, liberals, lawyers, prosecutors and reporters. Maybe even including John Kerry.
