Surely if Tim McVeigh was talking on the phone with a known terrorist, then he could have been tapped and caught.

The point is, that if you have evidence of wrong doing by one of the parties on the phone, then you have the right to listen in. But you must have judicial oversight, that is the law as the founding fathers envisioned.
