I'm not certain exactly what you mean

Forget for a minute about current law and think about how you would design from scratch a constitution/body of law to deal with evidence gathering for a criminal proceeding say for a new civilization being established on Mars. Then do the same for gathering intelligence in the prosecution of a war. In the case of evidence, you'd want a fourth amendment. In the case of intelligence gathering, not so much.

I'm struck by the number of prominent "conservatives" who have publicly expressed serious concerns about this.

I'm more struck by the number who are buying this commander-in-chief plenary powers thing hook line and sinker. Had a discussion yesterday with two sensible guys with a libertarian streak who, despite my challenge, declined to bat an eye over it. I would think that any powers so broad would give pause to anyone with half a brain and an ounce of libertarianism.
