I agree with your distinction, but the courts are instruments of government, they are not on the same level as persuasion or peer pressure.

I was. Interestingly, some years ago, a store opened in my town selling erotica. It caused a large stir. Much opposition was voiced in the city planning and city hall meetings, but in the end, county law did not provide any cover for banning them, so they opened. There was some minor vandalism IIRC, but eventually they closed due to lack of business. Peace and tranquility returned to town.
