Oh, I think this pretty much dismisses the argument that the war resolution right after 9-11 can be used as justification for domestic surveillance.

Two thoughts. (1) The Bush folk deliberately misstated this. (2) The only argument I can see still standing is the one that says it is "inherent" in the presidency. So far that branches in two directions. (a) The president never has "inherent powers as against the argument the office has them in "wartime." And (b) the various arguments as to when is "wartime."
