This is more complicated than you make out. There is a law in place that requires the use of a court to obtain a warrant to authorize the wiretaps. This President and past Presidents have said it is unconstitutional regarding it's effect on executive authority. Therefore GW has chosen, as past presidents have, to ignore it. It will have to be tested in a court of law. If it is found to be unconstitutional then it will fall to whether the congressional resolutions authorizing the Iraq war can be construed to cover the legality of authorizing the secret wiretaps.

Once those issues are taken care of it can be determined if the President committed a criminal act.

Whether it's war time or not makes no difference. Acting according to the laws and the constitution are always correct. Some think that because we are fighting an enemy we can use whatever tactics we want. But that goes against everything the constitution, and it's core meaning of transparent government and separation of powers. These are at the heart of what it means to be an American.
