If you asked a poll question, should police arrest bad guys and most people said yes, it would not be a realistic endorsement of arresting people without probable cause and beating confessions outs of them for the sake of law and order.

It's a false straw-man choice designed to endorse a position that was not able to gain widespread support on its own merits, like wiretapping without warrants.

That's the problem with partisan debate. Everyone is so desperate to achieve an outcome that supports their politicians and their agenda that subverting sound analytical processes is deemed fine and dandy.

That poll tells me nothing except that a bunch of people answered a deceptive question. I would never take the stance that we mustn't tell voters too much or we will confuse them. That's the kind of contempt we get from partisan politicians every day. Just let the big shots in power decided everything, kiddies.

Your final comment illustrates my point. We can have Bush's way or we can deprive ourselves of protection. My only choice? Of course not. We have a constitutional system that says we can have security and due process at the same time.
