Laws and Justice are not supposed to be a bunch of "gotcha's". It is supposed to be a system which makes society a better and more reliable place to live. To that end you can't expect justice if all responses are according to a formula, you might as well have a computer instead of a judge.

There is also a fairness issue if drugs can be used by the prosecutor to imply irresponsibility, then they should be allowed by the defense for whatever issue they bring to bear.

That's absolutely fine. Welcome to the libertarian POV - you pays your money and you takes your choices, and if you can't pay the piper then don't try a jolt on his pipe...

Seriously, I see absolutely no reason to fault this. OK, OK, if someone is forcibly dosed with intoxicants and then made to drive, they're not culpable, but notwithstanding Cary Grant in "North by Northwest" [my 3rd favourite film] I figure this is rare enough not to be the standard legislative measure.

I see no problem with this:

Drugs might explain why someone did something, but I don't see why they'd excuse murder, robbery and rape. I don't believe alcohol excuses those things (it may cause them in some instances, but people still seem to get punished. As far as I know you don't get a free murder under the influence- unless of course you are quite rich and famous, THEN you might get to murder someone and escape prison, but that has everything to do with money and it's influence, and nothing to do with drugs.
