re: There's always the hope that Alito could be one of those "surprise" justices, that have seemed to be properly aligned by those appointing and supporting them, but once on the court and out of reach of their enablers, have changed their positions greatly. Imagine a job where no one can fire you! Where you KNOW you'll still be there when your critics are long gone..

I also think there is a tendency on the USSC to move towards balance. I think they get on there, and by the contrary nature of lawyers start to disagree with each other (I know, my wife is a lawyer). If they all thought the same, what's the point?

Maybe that is just wishful thinking 'cause the USSC is going to be the "Bush Court" for the rest of my life.
