You listened without a warrant, then you try to use what you got without a warrant, to "track the owner down" and focus on him as a criminal. You don't get that? First of all, he's not being focused on as a criminal but as an enemy agent. You aren't going to prosecute him so the exclusionary clause is irrelevant. And second, you're not interested in that snippet for anything other than getting a warrant so that you can find out what he's up to. You're not trying to use "what you got without a warrant" improperly because you didn't need a warrant to get it. We agreed that you didn't need a warrant to get the snippet.
