Horse may not be gay, but it's still a nag

London - A former English literature student at one of Britain's most prestigious universities will not be prosecuted after calling a police horse "gay".

Magistrates in the city were told yesterday the Crown Prosecution Service - which oversees all criminal cases in England and Wales - did not wish to proceed.

Two police cars had descended on the High Street in Oxford on May 30 last year to arrest student Sam Brown after he collared a mounted officer and said: "Excuse me, do you realise your horse is gay?"

The 21-year-old, who was out celebrating the end of his final exams at the University of Oxford, was arrested and hauled before court for making "homophobic comments" and refusing to pay a £80 (about R850) fine.
