In early December 2005, the 11th circuit court of appeals ruled against the CNN Motions, and dismissed the application for sanctions.

It is my understanding that Zwebner asked the appeals court to toss out the Rule 11 Sanctions, so CNN asked for additional sanctions since they were being forced to spend additional money to fight it. Zwebner then withdrew his appeal so the court, as one might expect, denied CNN's motion for the additional sanctions.
