There is a 72 hour window where the govt can act before fisa rules. That theoretically should be good enough. I think buah and cheney are big getting more power for the exec branch. They feel that after vietnam too much went to congress. They may have done something unnecessary here and if so there may be a problem for them down the road. There are plenty of libertarian republicans like hagel and safire who think they overstepped.
PS Changing the subject. i saw bremer on russert yesterday and he refused to call rummy a bum and a liar but in effect thats what his book does. Rummy and Cheney--the guys i liked--turn out to be two old farts with antiquated views and in rummys case a poor decision maker. Rummy has hurt us big time in iraq. To bushes everlasting discredit he failed to fire rummy when his botchjob in iraq became clear.
