Setting a precedent where the CINC's hands are tied by courts during wartime would be unwise. This is a artificially imposed war, a war of Bush's choosing on a country that posed no threat to the US. Furthermore, the US has been in several wars in the past and none of the war time Presidents advocated the suspension of civil liberties of the very citizens who elected the President. BAd as it is that Bush ignored the warning of the impending 9/11 attack. It is even worse that he is now advocating the suspension of US civil liberties for his failure to contain the terrorists.
