Holding the clearance is equivalent to saying "Come on in, fellas" when it comes to counterintelligence investigations. Very true... Where I think this warrantless surveillance is legally justified is where phone calls between originator and recipient transcend national borders (regardless of actual path, possibly satellite, of the actual transmission). We all give up our right not to be searched when we step on an aircraft. We also give up that right not to be searched when we seek to re-enter the US. I believe the same logic has held with regard to warrantless communications wiretaps. If you talk with someone outside of the country, your communications are subject to screening. Personally, I can see where people are offended, or even frightened that very personal information, which is no national security value, might be stored and used against them in the future. I have the same feelings. But I also know that the ability to quickly track possible conversations between terrorists and supporters in the US are critical to uncovering terrorist networks and taking down their leadership. We wouldn't be able to fight this war effectively without this capability. Thus, this is going to reside somewhere in the nether-world, likely with stronger oversight and liaison between the FISA courts and those who are conducting the surveillance. The time window just must be shortened. Hawk
