With 72-hour retroactive warrants, there is no impediment or delay at all.

Makes sense and should be the logical process. Initiate the surveillance in the interest of expediency, while notifying the FISA court.

It will be interesting to see exactly what the fuss all seems to be about. That is, if the hearings aren't closed door and not publicly reported.
