That's called riparian rights, who gets the water. Lawyers can spend a career on one case and do. The Rio Grande runs THROUGH Taos, NX and they can't take a drop of water out of it. The water is owned by Texas by first use but they can catch the fish.

The Platte runs dry in spots, farmers get X amount of water but they have to return the X+ back into the river through drain tiles.
