The roads mostly all receive federal funds... making them all potentially subject to federal preemption (at least, under the newly expanded, 'everything under the sun is federal' Commerce Clause decisions)... so it would not be a stretch for the feds to claim the authority to ban anyone from driving on a 'public road' that they didn't want there.
