Then there is no check on the executive branch. They could take and hold any non-citizen as an enemy combatant (Taro for example) indefinitely.

I agree. Its hardly practical to require full court hearings on people captured in the course of waging a war. Its not like we put captured enemies through an extensive trial system (or for the most part through any trial system) when they where captured in any of our previous wars.
