As always lorne, you cannot discern between a physical search and electronic eavesdrop. In a physical search, the subject is aware of the scrutiny/search. In a electronic eavesdropping it it is "surveillance" and the subject is not aware. The law does not require Bush to inform Congress. It requires him to work with the FISA courts. THAT IS THE LAW: the FISA court and not Congress. He broke the law which possible has compromised the fundamental rights of Americans.
