Democrats concede Judge Alito victory

Sen. John Kerry dashed home from the Swiss Alps yesterday to man the barricades of a futile filibuster against Supreme Court nominee Judge Samuel A. Alito Jr.
Well before he reached the battlefield, however, Democrats had waved the white flag and agreed that next week's vote to confirm Judge Alito will surely succeed.
"Everyone knows there is not enough votes to support a filibuster," Minority Leader Harry Reid said yesterday, several hours before Mr. Kerry arrived.
By midday, Republicans had dubbed Mr. Kerry's international politicking the "Swiss Miss."
White House spokesman Scott McClellan called it a "pretty historic" day.
"This was the first time ever that a senator has called for a filibuster from the slopes of Davos, Switzerland," Mr. McClellan said. "I think even for a senator, it takes some pretty serious yodeling to call for a filibusters from a five-star ski resort in the Swiss Alps."
Meanwhile, Sen. Kent Conrad, North Dakota Democrat, announced yesterday he is "leaning in favor" of the nominee. He would join at least three other Democrats who plan to vote with the vast majority of Republicans in favor of Judge Alito.
"It is clear to me that a majority of the American people and the people I represent support his confirmation," Mr. Conrad told reporters after meeting with Judge Alito yesterday. Also, several more Democrats announced that while they may oppose Judge Alito, they will permit his nomination to get a final vote on the Senate floor.
Still, Mr. Kerry would not be deterred.
"I know this is flying against the political punditry of Washington," he said after arriving in the nearly empty Senate chamber yesterday afternoon. "But this is a fight worth making."
No longer constrained by a self-imposed rule during his campaign against using any French words, Mr. Kerry said Judge Alito's confirmation amounted to an ideological "coup" at the Supreme Court.
Mr. Kerry's speech came after 12 hours of Republican ridicule -- both for the futility of his filibuster strategy and for the fact that he announced it while attending the World Economic Forum in Switzerland.

"Kerry Calls for Le Filibuster From Swiss," the Drudge Report said.
"I suppose we can all agree that it is an international filibuster because it was apparently hatched in Davos, Switzerland, where Senator Kerry now is with those masters of the universe that are out there trying to figure our world economy out," said Sen. Jeff Sessions, Alabama Republican.
Even the New York Times, which had ordered the filibuster in an editorial only hours before, noted in yesterday's editions that Democrats "cringed" at the "awkwardness" of Mr. Kerry's international wheeling and dealing.
Few think Mr. Kerry's effort will succeed. Among those few was Democratic strategist Bob Shrum.
"I think there's a very real chance to get those 41 votes" for a filibuster, he told TV's "Hardball" host Chris Matthews. "And I think some pressure ought to be put on moderate Republicans, like Lincoln Chafee in Rhode Island, who says, for example, he's pro-choice, but is under a lot of pressure from the administration to vote for Alito."
While most Republican scorn was directed at Mr. Kerry yesterday, some was reserved for Mr. Reid.
On Thursday night, the Democratic leader publicly agreed that all debate on the Alito nomination will have been exhausted by the time the Senate votes on it next week. But by yesterday morning, he had decided that he would support a filibuster anyway.
This, to Republicans, smelled like Mr. Kerry's claim during the 2004 campaign to be for the Iraq war before he was against it.
"Harry Reid's position on Judge Alito's confirmation has more holes that a slice of Swiss cheese," said Tracey Schmitt, press secretary for the Republican National Committee. "After stating an unwillingness to support a filibuster, it looks as though the Davos Democrats were able to twist Reid's arm enough to switch him from 'Filibuster? Not me.' to 'Filibuster? Oui! Oui!'?"

10. John Kerry pointed out that Dick Cheney’s daughter, Mary, was a lesbian, only as an example--nothing more. In truth, John Kerry wanted to be sure that the far religious-right knew that the vice president had one of THOSE people for a daughter. In case the religious people missed John Edwards saying it, Kerry repeated it for them.



George Bush is responsible for the flu vaccine shortage. Wrong. People like John Edwards are responsible for the shortage. Because of frivolous lawsuits by money-grubbing lawyers like Edwards, few American companies will produce the vaccine anymore. This has forced the government to go out of the country to purchase adequate amounts of the vaccine. The millions of dollars that companies must pay out to blood-sucking lawyers who file law suits for people who get a pimple on the arm where they received the shot, have caused this crisis. If you get the flu this year, send a thank-you note to John Edwards.


8. John Kerry has a plan for Iraq. Kerry will train Iraqi soldiers and policemen to protect their own country--but faster. Kerry will magically convince all those countries that were scamming the “Food for Oil” program to send troops and the United Nations will ride into town on white horses and save the day. In truth, John Kerry has two plans for Iraq: DUMP and RUN. Dump the future of Iraq on the United Nations and run home.



7. John Kerry will make health care available to each and every American. This hair-brained socialized medicine plan will cost trillions of dollars and the government will be in charge. Perhaps the best part of his health care plan is this: The ''government'' will pick up the tab for any catastrophic expense over $50,000 to ''help keep your health insurance premiums down.'' The problem with this is that Kerry will have to take 80% of everyone’s income to pay for this little break for the insurance companies that will be shifted on to the backs of the taxpayer. Ladies and gentlemen, please stop and think about where the ''government'' gets its money.



6. John Kerry understands the plight of the ''common man.'' John Kerry and his lovely wife, Ter-RAY-za, entered a Wendy’s for a photo-op. Teresa had never seen the menu and apparently didn’t know what chili is--she had to ask. Of course, this food of the ''common man'' never passed their lips. After the appropriate pictures were taken, they both rushed from the place and were probably relieved when they got to their posh touring bus where an expensive and catered supper awaited them. After taking a few bites, the Edwardses excused themselves and joined the Kerrys.



5. John Kerry will fix Social Security. John Kerry’s plan to fix Social Security is to do nothing. Young Americans will absolutely NOT be allowed to be in control of 1% of their input to the FICA plan. That would be ''disastrous.'' Yes, it might be for future Democrats because if there are no elderly poor, they will loose a huge voting base. In fact, the total collapse of the Social Security system will happen after Kerry leaves political life and since he is stinking rich, he doesn’t really care what happens to the program. Kerry will be yachting somewhere.



4. John Kerry will roll back the tax break on all those people who make over $200,000 year. With this tax cut, Kerry says he will pay for: universal health care; four years of college for all who wish to go to college; add 40,000 troops to the military; put more cops on the streets and firemen in the firehouse; cut the deficit in half in four years; check every box and crate that enters the country through our ports; AND give a tax break to the middle class. That is a ''short list'' of his promises. It can’t be done. Of course, this will not apply to Kerry himself, who has most of his money in tax free shelters. If you grossed $50,000 last year, you probably paid somewhere in the 25-35% tax range. Billionaire Teresa Heinz Kerry, who cleared well over $5 million last year, paid somewhere in the 12% bracket. Note: It was reported that George and Laura Bush paid over 30% of their income in taxes.



John Kerry is a good Catholic. This writer is a Catholic, so I can talk about this. John Kerry stated that he believed that life begins at conception. If he believes that, it does not square with Kerry’s belief that even the infanticide called ''partial birth abortion'' is just fine. Kerry states that he can’t force his beliefs on others. What? When did this happen? We should find Hitler, dig him up, apologize and put him back in power because we had no right to impose our belief that genocide against the Jew was wrong. The Klu Klux Klan members believe that people with black skin are inferior to them yet our legislature has imposed laws on them from acting on this belief. Other people’s beliefs are pushed on Americans every day. Isn’t the belief that it is a woman’s ''right'' to abort her baby pushed onto us pro-life people every day?


John Kerry and the entire Democratic political machine keep insisting that thousands of Florida voters were “disenfranchised” in the 2000 election. This is simply not true. Two separate investigations by civil rights groups found absolutely NO harassment of Black voters nor any attempts to throw out their votes. What was found was that more ballots in heavily African American precincts were spoiled by the voter. The only real problems found were that some Haitian Americans did not have ballots that they could read and some Hispanic voters were abused by Democratic poll workers in Democratic precincts. There were also problems with the list of felons that were not allowed to vote. Contrary to the Democratic screeching, the vast majority of those on that list were White, not Black or Hispanic. The present hysteria that the Democrats are attempting to create is a pre-emptive strike to create the same chaos in Florida--and other close states--that Americans witnessed in 2000. In short, it is a pre-election attempt to steal the election. Note to Democrats: Not allowing the dead to vote is not ''disenfranchisement'' even if those dead voters are African American.


The greatest lie told by John Kerry is that he is “looking out for the middle class.” Many Democrats alive makes this statement and in the forty years that they had control of the Congress, they did very little for the middle class. Lyndon Johnson’s ''War on Poverty' created millions more poor and dependant Americans. Johnson never would have passed the Civil Rights Bills had the Republicans not worked overtime to get them passed despite the likes of Al Gore Sr. and Robert Byrd--both Democrats who were adamantly against all Civil Rights Bills. In Kerry’s twenty years in the Senate, he did little to help the middle class. All he managed to do was raise our taxes to help create his vision of a socialistic state. Kerry has rarely ''mingled'' with the middle class and apparently has little desire to do so. Kerry does know that he needs the votes of the middle class, so he will pander to them shamelessly to get what he needs. My guess is that after ''slumming'' Kerry will promptly return to one of his estates, take a shower, and have his butler make him a special peanut butter and jelly sandwich, and try to put this unpleasant election experience out of his mind.

John Kerry Lies
Officially announcing his candidacy for president, Senator John kerry stood in front of the USS Yorktown and lied about his vote in favor of the Joint Resolution to authorize the use of United States Armed Forces against Iraq. Kerry asserted in his announcement that he voted in favor of "threatening" to use force against Iraq. Either John Kerry believes Americans cannot read or he cannot do so himself. The resolution contains the statement "The President is authorized to use the Armed Forces of the United States as he determines to be necessary and appropriate..."

It does not read that the President is authorized to use the THREAT of force. The threat was actually contained in UN Security Council Resolution 1441, I don't believe Senator Kerry got a vote on that. Kerry has repeatedly accused the president of misleading the American people and himself into supporting the war. Now it would seem that it is Senator Kerry who is doing the misleading. And if the American people are paying attention the only one who will be mislead is Kerry himself.

Kerry Lies On Social Security, Flu Vaccine And The Draft

America’s liberal mainstream media refuses to report on the consistent lies coming out of the mendacious mouths of Senators John Kerry and his running mate John Edwards.

American voters and taxpayers are being fed a flood of lies by Kerry-Edwards, beginning with Social Security, the military draft and even the flu vaccines that are in short supply.

The list of lies goes on and on. . . . but voters and taxpayers will never know the truth, even when President Bush and the Fox News Channel and talk radio hosts expose Kerry’s ludicrous lies that are not reported by the New York Times, ABC, CBS, CNN, NBC and Associated Press, the world’s largest news wire service.

So here’s the Truth:

1. Kerry-Edwards scare senior citizens and the “Baby Boomers” born between 1946 and 1964 by telling them that President Bush is going to kill Social Security. WRONG! Bush and the Republican Party are offering those born in recent years to start their own retirement accounts at much higher investment returns than Social Security. The Bush-Republican plan is purely voluntary. No one has to do it.

2. Kerry-Edwards blame Bush for the shortage of flu vaccines. WRONG! Kerry voted against legislation that would have protected vaccine manufacturers from punitive damage lawsuits by trial lawyers. (Kerry and Edwards are both trial lawyers, like Bill and Hillary Clinton.) Trial lawyers have been suing manufacturers and businesses, including doctors and hospitals, for “negligence,” forcing them to shut down or move out of America where there are not tens of thousands of lawyers filing lawsuits every day, many of them frivolous. The cost to America’s economy exceeds $500 billion a year.

3. Kerry-Edwards are telling voters that President Bush is going to reactivate the draft to recruit more men and women into the armed forces. WRONG! Only two members of Congress, both liberal Democrats, introduced legislation to bring back the draft. The legislation was defeated almost unanimously by both parties. The only two votes for the legislation were from the two liberal Democrats, one a U.S. Senator, the other a Congressman from New York City – Charles Rangel.

The Democrats continue to play the “race” card to get the black vote. It won’t work. President Bush has more blacks in his Cabinet than Bill Clinton, who called himself America’s first “black” President (another big lie). Among Bush’s closest advisors are his Secretary of State, his National Security chief, and his Education Commissioner – all prominent black leaders in America.

The Democrats continue to create “class warfare,” by labeling Republicans the rich and powerful, and the Democrats the protectors of the poor. WRONG! “U.S. News & World Report” publisher, Mort Zuckerman, wrote last week that the Democrat Party today is comprised of the rich and elitist members of American society, led by Kerry and Edwards, both multi-multi millionaires, far richer than Bush and his vice president Dick Cheney.

Teresa Heinz Kerry is a billionaire, and John Edwards, one of the wealthiest trial lawyers in America, has more money than both Bush and Cheney combined!

So much for “class warfare” propaganda by the Far Left, led by Kerry-Edwards.

Kerry is the leading “liberal” in the Senate, and Edwards is ranked the fourth most “liberal” member of the Senate.

They are the liberal leaders expanding America’s already Big Government “Socialist State.”

In Kerry’s so-called “Winning First Debate,” the Fox News Channel found some 25 lies, misrepresentations, distortions and contradictions made by John Kerry. As a Yale lawyer, he should know better.

Americans finally have a clear choice for President: Bush Vs. Kerry.

Kerry is a slick, smooth, slippery speaker with a 20-year record in the U.S. Senate that produced only one piece of legislation approved by Congress. Kerry was AWOL most of the time while a Senator. Last year, he missed all sessions of the Senate while preparing for his presidential campaign. Kerry has missed 76 percent of the Senate voting sessions since he has been in Congress.

O'Neill leads charge against Kerry's 'lies'

John E. O'Neill is the former Swift Boat commander in Vietnam who has led a rapid-fire assault on Democratic presidential nominee Sen. John Kerry, causing a media furor and an angry response from both the Kerry campaign and the candidate himself.
He has called Mr. Kerry a liar, said he falsified his war records to receive combat medals and scurrilously tarnished the reputation of other Vietnam veterans for political gain. He accused the Massachusetts Democrat of having serious character flaws that made him unfit to serve as commander in chief.

As the most visible face of the newly formed Swift Boat Veterans for Truth, Mr. O'Neill has led the charge to counter what he and his fellow members have called "the false war crimes charges John Kerry repeatedly made against Vietnam veterans who served in our units and elsewhere, and to accurately portray Kerry's brief tour in Vietnam as a junior grade lieutenant."
"It was important for me to be involved in this because everything is not just politics," Mr. O'Neill said yesterday in a telephone interview. "All of us spent a year of our lives in Vietnam and the truth of what happened and what we did is important.
"Kerry is a guy who deeply lied about what happened and that has been demeaning to those of us who were really there. He misrepresented his record and ours in Vietnam, and there's no question some names on the Vietnam Memorial belong to him once he began to criminalize our troops and give voice to the anti-war movement," he said.
Democrats have portrayed Mr. O'Neill as a shill for the Bush campaign, but he says he is not a partisan and he actually voted against Mr. Bush in 2000, supporting Al Gore, and Ross Perot in 1996.
But just who is John O'Neill and why is he saying those things?
The answer to that question is best summed up by the Swift Boat veterans organization itself, which began its newest and undoubtedly last mission for one single reason: "For more than thirty years, most Vietnam veterans kept silent as we were maligned as misfits, addicts and baby killers. Now that a key creator of that poisonous image is seeking the presidency, we have resolved to end our silence."
Roy Hoffmann, a retired rear admiral who is one of the founders of the Swift Boat Veterans, which formerly was known as the "Group of Twelve," as in 12 months' duty rather than the four served by Mr. Kerry, called Mr. O'Neill "a very intelligent man ... with an impeccable record as far as being a man of integrity."
Adm. Hoffmann described himself as chairman of the organization, but called Mr. O'Neill "the brains."
Mr. O'Neill, a 1967 cum laude graduate of the U.S. Naval Academy and now senior partner at a Houston law firm, served as a Swift Boat commander in Vietnam in 1969 and 1970 as part of Coastal Division 11.
Receiving two Bronze Stars and other decorations, he succeeded Mr. Kerry as commander of PCF-94.
Under Mr. O'Neill's command, PCF-94 was fired on several times as it patrolled near the Cambodian border, as well as the Uminh and Namcan forests in southern Vietnam. He said his boat patrolled an area about 100 yards outside the Cambodian border for nearly three months.
But his current criticism of Mr. Kerry is not new — not to this year or to this presidential campaign.
He first challenged Mr. Kerry on the U.S. role in Vietnam in a 90-minute debate in June 1971 on the "Dick Cavett Show" — just two months after Mr. Kerry, then a new member of the Vietnam Veterans Against the War, had mesmerized the Senate Foreign Relations Committee and a national television audience with gruesome tales of Vietnam War atrocities.
Mr. O'Neill said he learned of the testimony while in a Texas hospital, where he was being treated for a knee injury. He wrote to the committee for a chance to rebut the accusations, but was not called to testify. He said he was "outraged" by the comments "because I had many close friends killed in Vietnam."
Mr. Kerry told the committee that U.S. soldiers and sailors in Vietnam "personally raped, cut off ears, cut off heads, taped wires from portable telephones to human genitals and turned up the power, cut off limbs, blown up bodies, randomly shot at civilians, razed villages in a fashion reminiscent of Genghis Khan, shot cattle and dogs for fun, poisoned food stocks and generally ravaged the countryside of South Vietnam."
Dressed in combat fatigues, Mr. Kerry also said the acts "were not isolated incidents but crimes committed on a day-to-day basis with the full awareness of officers at all levels of command."
Mr. O'Neill vigorously challenged the accusations in the Cavett debate, saying he served in the same unit as Mr. Kerry and had seen nothing to "shock the conscience." At one point during a heated exchange, Mr. O'Neill demanded that Mr. Kerry explain why, if he saw atrocities taking place, "you didn't do something about them."
Mr. Kerry then said the incidents had been relayed to him by other veterans, although several members of the Vietnam Veterans Against the War later were discovered to have never actually seen combat.
Although contacted by the Nixon administration before the debate to serve as a counter to the Kerry accusations, he said the White House had nothing to do with getting him on the show.
"Cavett and the White House didn't speak," he said, adding that Mr. Cavett had been on Mr. Nixon's enemies list at one point.
Wearing the only suit he owned, Mr. O'Neill paid his own way to attend the Cavett broadcast.
"Before the debate, I thought Mr. Kerry was going to be an angry guy," he said. "I was shocked to find out that he was not. There was no passion to his rhetoric. At one point, I called him a moral coward and his only response was to say 'Wow.' I would have responded differently."
Mr. O'Neill's ties to the U.S. Navy are long-standing. His grandfather taught at the Naval Academy and his father also graduated from Annapolis in the 1930s, later serving as a fighter pilot before retiring as an admiral. His two brothers also are academy graduates.
Following his Navy service, Mr. O'Neill received a law degree from the University of Texas in 1973, graduating first in a class of 550, and went on to serve as a law clerk to Supreme Court Justice William H. Rehnquist, now chief justice, from 1974 to 1975. He now specializes in large-scale commercial litigation at the Houston law firm of Clements, O'Neill, Pierce, Wilson & Fulkerson, a firm he helped found.
Mr. O'Neill said his recent call to political action again occurred in a hospital room. He said he was recovering from surgery after donating a kidney to his wife of 28 years, Anne, when he saw Mr. Kerry on TV in February.
"I was in the recovery room at Methodist Hospital and saw John Kerry on television, laying claim to his Vietnam War record. I just couldn't believe it," he said.
It was then he helped form the Swift Boat Veterans for Truth, whose primary projects have included its Web site, a book "Unfit for Command: Swift Boat Veterans Speak Out Against John Kerry," and campaign ads challenging Mr. Kerry's military record and anti-Vietnam War activities.
He said Mr. Kerry "grossly and knowingly" distorted the conduct of U.S. military personnel in Vietnam, calling his anti-war statements a "betrayal" that put soldiers and sailors still in Vietnam in harm's way.
Mr. O'Neill said his attack of Mr. Kerry is not about forgiveness, but a question of fitness.
"The allegations are lies and he knew that when he made them," Mr. O'Neill said. "The words he used have haunted many Vietnam veterans, some for their entire lives."

Kerry lies about his record

Kerry Denies Quotes Accusing U.S. Soliders of War Crimes

In a stark about-face, Democratic presidential front-runner John Kerry is now denying that he ever accused U.S. soldiers of committing war crimes in Vietnam, despite amply documented comments - some televised, others delivered while under oath - in which he did exactly that.

Asked on Thursday whether he had accused his fellow soldiers of committing war crimes in Vietnam during his April 1971 testimony before the Senate Foreign Relations Committee, Kerry told CNN's Judy Woodruff:

"No, I was accusing American leaders of abandoning the troops. And if you read what I said, it is very clearly an indictment of leadership. I said to the Senate, where is the leadership of our country? And it's the leaders who are responsible, not the soldiers. I never said that."

However, a transcript of Kerry's April 22, 1971, testimony contains accusations that his brother soldiers committed all manner of atrocities, charges he based on interviews of returning Vietnam vets earlier that year at the Winter Soldier Investigation, an event Kerry organized with anti-American actress Jane Fonda.

Kerry told the Senate that Winter Soldier witnesses "testified to war crimes committed in Southeast Asia, not isolated incidents but crimes committed on a day-to-day basis with the full awareness of officers at all levels of command."

Speaking under oath, Kerry continued:

"They told stories at times they had personally raped, cut off ears, cut off heads, taped wires with portable telephones to human genitals and turned up the power, cut off limbs, blown up bodies, randomly shot at civilians, razed villages in fashion reminiscent of Genghis Khan."

A few days before his Senate testimony, Kerry gave the following account on NBC's "Meet the Press":

"There are all kinds of atrocities, and I would have to say that, yes, yes, I committed the same kind of atrocities as thousands of other soldiers have committed in that I took part in shootings in free fire zones. I conducted harassment and interdiction fire. I used 50 calibre machine guns, which we were granted and ordered to use, which were our only weapon against people. I took part in search and destroy missions, in the burning of villages."

The future presidential candidate added:

"All of this is contrary to the laws of warfare, all of this is contrary to the Geneva Conventions and all of this is ordered as a matter of written established policy by the government of the United States from the top down."

Appearing on "The Dick Cavett Show" in July 1971, Kerry admitted that he'd never actually seen some of the atrocities he testified about, but still maintained that U.S. soldiers fighting in Vietnam routinely violated the Nuremberg Principles.

"I personally didn't see personal atrocities in the sense I saw somebody cut a head off or something like that," he told Cavett. "However, I did take part in free-fire zones, I did take part in harassment and interdiction fire, I did take part in search-and-destroy missions in which the houses of noncombatants were burned to the ground."

Kerry continued:
