We (you and I) don't think there is one now- which isn't the same as there not being one. The possibility of its existence exists- and it certainly hasn't been foreclosed. As you know, rights, as far as the SC is concerned, are a bit retroactive- so the case that brought the question could very well be happening right now, or already have happened, and thus the right would already exist, even though it wasn't pronounced until the future. Is that too nuanced? :-) Can there be such a thing as too nuanced?
