You are assuming that the common US citizen is a criminal and the onus is on the citizen to prove their innocence. Very contrary the the laws of a civilized society.

The 1978 FISA law is meant to protect the civil liberties by involving the judges. This constitution has always provided checks and balances and does not vest too much power in any single branch. Hence the FISA law was enacted to provide for that. And if Bush does not believe in our constitution and our system of laws, then those are grounds for impeachment.

Nobody has the right to talk to the terrorists in secret in the same manner as the President not having the right to assume dictatorial powers by telling the judicial branch that they have no right even if the law provides for that. The President cannot tell the judges to go fly a kite on this issue.
