Highly unlikely is more like it. Confirmations are about cloture. If that is precluded-as it has been twice-the left doesn't stand a chance in hell. Alito and Roberts aren't the only qualified judges to nominate.

Some conservatives rightly say that we should have a national debate over abortion and several other moral issues. The Dems have been allowed to get away for far too long with the BIG LIE that any majority of Americans favor Roe v Wade.

But you won't see it in this Congress. The Dems are BEAT for the rest of the session on judicial confirmations, unless a mistake is made and someone not technally qualified gets nominated (and Bush has learned from the one he just had to drop: Myers.) Nor will my dream scenario: Cheney casting the 51st vote to get our guy in, materialize.

The idea that the NEXT ONE will be the "real fight" has been proven to be pure MSM switchgrass. The "real fight"-if you recall-was going to be when the first Bush USSC nomination occurred. When they blew it with Roberts, suddenly the SECOND appointment would be the "real fight". Now the THIRD appointment is going to be the "real fight". The "real fight" has ALREADY come and gone, and the Dems have LOST this battle for the rest of this session. And given that the chances of the Senate Dems even picking up ONE extra seat in 2006 are BURIED, Bush will continue to build the Court through 2008. Expect 2, 3 or even 4 new appointments from here...
