In some states, every sale IS supposed to be done through a dealer and the background check is to be done. In CA, guns can't be sold through classified ads.



Personally, I've never sold a gun - I just keep buying more. But if I did do a private transfer to a stranger, I would like to know I'm not selling it to a criminal or someone with a domestic violence conviction. However, I think the NICS check should be free - to do otherwise raises the cost.

I personally know of some individuals who on their own have required the buyer to go through a licensed dealer at the gun shows - sometimes this kills the deal, but they feel better.

You can also get a C&R (curio and relics) license from the ATF, good for three years to buy and sell guns for your personal collection that meet the C&R requirements - generally 50 years old and of historical significance. This is not a license to buy and sell for profit. Under the C&R other dealers FFL or C&R can send them directly to your home via the post office and you never need to use NICS. You are in fact a dealer and must maintain records and log guns in and out and allow the ATF spot inspections to your home and storage facilities at any time. So if you're collecting a lot of older guns off of GunsAmerica and the like, watch for the C&R reference - you could save yourself $50 each time by not having to use an FFL (federal firearms licensee) each time. Some folks are afraid of the C&R as they think the govenment is spying on them - please, if you've ever had a NICS check done - consider yourself in the big database regardless of the pledge the records are not held for more than 30 days.
