What am I missing here? The NYT's frantic attempt to reassert privilege. :>) In the DC Circuit Court of Appeals, at least, the law is settled. There is no reporter's privilege (recall that the SCOTUS refused cert.). I'm not aware of any other Circuit that has adopted a reporter's privilege either (and if there were, it is likely the SCOTUS would have accepted cert in Judy Miller's case to settle the question). The NYT is flailing in its frantic attempts to push its agenda.
