I saw a quote from Pat Leahy among others saying that Congress will do whatever they need to the FISA legislation to make it work the way Bush wants it to.

If Bush had been smart (and a uniter rather than a divider) he would have put Ashcroft, the FISA judges, the NSA director and the Congressional leadership in one secure room in late September 2001, and said what do we need and how do we get it done within the framework of the law and the Constitution?

Then he tells them he wants a plan that will pass Congress lickety-split that meets everyone's needs. If he doesn't get that plan, he will veto the bill and tell the American public why and who is responsible.

Once he has that bill and the FISA system works to everyone's satisfaction, the NY Times never has a story. They find out about a legal wiretapping program that words under FISA oversight and the national affairs editor says, "So what's the story in that?"

Game over, everyone wins except the bad guys.
