A 28 gauge spreads about 2 feet at 30-40 yards. Lots of pellets. about 180 pellets at that distance in a 30 inch circle with a modified choke.

My guess is that the pellets are not that deadly at that distance. I have been sprayed from 100 yards+ and it is harmless. After 40 yards the effect is minimal except at max choke and magnum loads. You would get penetration though, at 30 yards and less. Not nice. Hard to work on.

I don't think the hit was a direct one, but only part of the pattern. It amounts in my estimation of half the pattern spread at about 30 yards. This is based on where he was hit, and the estimates of the pattern at that distance.
