The way I read it, he's saying that FISA should be changed to authorize what Bush has been doing although with judicial oversight. And that it should be understood that Bush didn't have that authority without congress giving it to him. IOW, what Bush did was the right thing to do and should be authorized so he can legitimately do it. He wants to keep up the wiretapping but disabuse Bush of his assault on balance of power.

Interesting paragraph. I think we agree but I think it means that Will wants, forget what I want for the moment, is to keep FISA or a FISA like process in place, to do so without saying something like "George, you did wrong," If that's the compromise that would work, who could object. But that won't work. The Bush folk, best I can tell, wish to do away with the process of getting warrants for wiretapping.

And then there are all the issues involved in the data mining stuff which will preoccupy all of us once it gets brought, more forcefully, to public light.
