That's handled by Cheney declassifying Plame before outing her. By presidential order Bush gave that power to his VP. So when Cheney told Scooter about Plame, he defacto declassified her...therefore Scooter is not guilty of outing a CIA agent. And neither is Cheney. See how that works? That makes JLA correct on this matter...as it turns out...at least I expect that to be the argument. See the Dowd piece in today's NYT.
