Actually, it's the one that's been bandied about a great deal. Nor does it trivialize. The court, by reputation, handled requests very efficiently. But the Bush administration had a variety of levels of approval, etc. before it would approach the court. I suspect some of those were mandated by the entire process; perhaps some were not.

It's telling that the Bush folk have said so little about it publicly.
