Jeff, As I've posted before, it's not the semantics of how you define whether a short is naked or not. I've posted my thoughts on changing the environment with respect to toxic funding and dumping. I'd prohibit all dumping before total disclosure. Make deals really disclose the cost. Fairly simple. If it means a company has to say it is financing at 50% APR, then so be it. Take the "sucker" off the face of retail investors. This should be the goal of "both sides" presumably if they are not dominated by special interests.

The reason for the above paragraph is that I'm not sure what you mean by putting that form of shorting aside. If you mean you agree that it should be part of the discussion that might lead to regulatory change, then I agree. Per my prior post, I prefer a broader approach so it doesn't denigrate into semantics of what is a naked short. Let's put together a comprehensive plan that makes trading more fair, with information available to all and then define manipulation as, inter alia, those actions which fail to comply with the new regulations.
