"Take military action" does not equal "declare war". Alito's said - "The president has the power of the commander in chief. And I think there's been general agreement and the Prize cases support the authority of the president to take military action on his own in the case of an emergency when there is not time for Congress to react." That isn't even close to saying that the president has the power to declare war, let alone "that the president has the right to declare war inspite of what the Constitution has to say on the subject", he is talking about what the constitution and relevant supreme court decisions. oyez.org caselaw.lp.findlaw.com Tim
