And he was tracked and apprehended legally as far as I know.

I believe the controversy is over whether to treat him as an operant of a foriegn enemy with intention and operational plans to attack America, or as an American Citizen who has similar destructive intent.

You could look at him like Tim McVey because Tim committed a terrorist act, by attacking an American Government building containing innocent (non military) targets. Tim was trying to revolutionize America for his brand of American idealism. So his base was totally from the perspective of an American citizen. Jose was operating with funding, resources, and as an agent for a foriegn enemy.
