Skype did it to itself. They were found out very quickly. Intel has used the CPUID name string check in their compilers and the code they generate. It has done this for YEARS! As for a slander lawsuit, I could merely point to the relevant websites. AMD itself is taking point against Intel for this and many other practices.

Besides, ATI may do something, if it becomes public knowledge that a their flagship tests as slow as their competitor's last generation GPUs. They could simply blame Intel for doing a botched job on the driver as an easy out. Of course if an official ATI driver was ever found with something similar to Skype, their reputation wouldn't survive such a disaster. The last time I used ATI cards, I went away from them, because of issues with their lousy drivers. The fact that they stopped updating them also hurt a lot too. Getting your reputation back after losing it badly, is very hard.
