President GHW Bush 41 was weak and needed to appoint someone that the Democrat controlled Senate would confirm. It is possible that Democrat could control the Senate after the midterms in 2006. The type of appointee that would be approved might be different in that situation.

Even considering that, if President Bush were appointing the next Justice, we couldn't help but improve the quality of jurisprudence if Ginsberg or Souter were to retire.
