I have no idea why one would not assume that the NSA transnational monitoring of number associated with terrorist outside the country who are not Americans would expect calls made in or out of America to such involve Americans at either end of the call. Making war is not making crime perse.

In addition the entire concept of court approval is about evidence and criminal prosecution as the goal. The NSA monitoring is about live tactical cummunication in actions of War against America.

In the IRS code for example, there are many cases where depending upon how one treats some transaction it is income or expense or not. And one has rules to decide.

The voluntary actions of the President with 45 day reviews of the numbers and the consulting with the courts show enormous respect for the sensitive nature of the difference.

I wonder at what kind of idiotic cannot see in this context how petty and foolish they are over an issue of grave national security.
