No, it is VERY MUCH constitutional to ignore the "rule of law" when the nation's survival is in danger in war time. The Founders had absolutely no illusions about that.

In this age of judicial dictatorship, we have been conditioned to think otherwise. That doesn't change it. And if that judge spares the terrorist, it will move us a LOT closer to ripping down the drunk-with-power Imperial Judiciary, that has oppressed us for decades.

(I'll bet you also didn't remember that a jury has the authority to ignore judge's instructions, including written ones that result from the negotiations of the opposing counsels. That, too, is constitutional-though carefully kept secret by judges and "officers of the court".)

And in THAT respect, if the judge fails America (especially if she's ARROGANT about it), it may be a GOOD thing...
