Here's the full quote:

Apparently Bush thinks that the Constitution guarantees that court orders be obtained.

But still the legality is a side issue. Bush said:

"...any time you hear the United States government talking about wiretap, it requires -- a wiretap requires a court order."

I presume that any time means...any time. Your argument now hinges on the meaning of any time?

I presume that the executive is part of the United States government...so therefore a court order is required even when the executive orders it.
