I'm not a lawyer but I am 99% sure that immigration violations are always criminal offenses, including hiring illegal aliens.

One topic where I don't agree with many pro-immigration types is the howling and screaming when someone is locked up "just for immigration offenses". Hey, you enter a country illegally and get caught, you go to the slammer and then get deported. That's how the rules are written everywhere I have ever been.

The issue of resources and will to do that with every illegal is a whole separate issue. Violating your visa status is a criminal offense, pure and simple.

Agree with Dale, illegal immigration is a crime. What they are talking about now, I believe, is ratcheting up the penalties for employers, who have the most to lose. They can't just run away.

With all the chatter about making illegal immigration a criminal offense, would any of the lawyers consider taking the time to interpret the implications of that action?

As a criminal offense it would require more thorough procedures, a higher burden of proof and probably more opportunity for appeal.
