Laz, What you mean is the IRS should not be able to tax you on money you did not make.

In a tourist-rich city, the IRS will assume you, a waitperson or any other tippable employee, made yea so much in tips and will expect you to pay taxes accordingly. The burden of proof will be on you to prove that you did not make that much in tips. Yup, it's been through the courts. - Holly
