The headline is misleading. What the judges said:

<"If a court refuses a FISA application and there is not sufficient time for the president to go to the court of review, the president can under executive order act unilaterally, which he is doing now," >

As far as I know the FISA court acted in a timely manner on every request, therefore the President must show that FISA did not do their job to justify legality of his wire tapping.

The five judges testifying before the committee said they could not speak specifically to the NSA listening program without being briefed on it.

Sounds like uninformed opinion.

Americans have the right to privacy. Gingrich was plotting deception of the American people and his conversation was taped. I think that under the law that this is illegal. But so is plotting deception against the American people...especially when you're an elected official.

Speaking of deception...where are those WMD?
