EK - As I've often posted, anything that exposes the scamming in the industry is good news to me. I don't care whether it turns out to be less of an issue than claimed by O'Brien or more. As with most issues, the "truth" typically lies between the views of those who have extreme views on either sides. No doubt, there are vested interests on both sides.

I doubt it gets to the point that you mention. I'm sure there is enough scamming around to require a rework of the system. The SEC can't handle a clear cut case, let alone something this complicated.

It's going to take a ton more publicity to get deep into this stuff and that's why all the articles and 60 Minutes, etc., is good as far as I'm concerned.

There is way too much personal attacking on both sides. I can understand O'Brien's need for anonymity, given the tendency of scammers to try to get to someone personally in a variety of ways, from threats to intimidation to wild claims. Gary Weiss has been a total wind bag, not much better than an internet message board or blog poster.

So, let's not get into who says the most defamatory stuff. Let's both (and all) be thankful these issues are in the news. Why fight it? Let it play out and get it over with. If it turns out to be a minimal problem, we will, at the very least, wind up with more fair markets. The only ones who won't be happy are those who want "the easy way," i.e., the ability to scam retail investors.
