I don't think we could justify even a counter attack with the UN crowd. On the other hand if it was a counter attack - I don't think any of us would care :-)

Operation principles during the Cold War had Defcon 1 alerts issued when we thought the Soviets were contemplating a first strike - Cuban Missile crisis comes to mind. However we didn't launch at that point - we simply 'turned off the safety' and waited for the other guy to blink.

Launching was initiated if they launched - under these circumstances all Soviet launches were assumed nuclear.

Does this sound pre-emptive? After all at the point we would have launched no American had yet died and no Soviet missile was in US air space.

Adequate provocation needs definition in this new environment. But I would assume they have nukes - and hence assume any launch is a declaration of war.
