If there are strong disincentives towards making claims, employers of illegals are at a tremendous economic advantage.

Oh, they go to court, and "La Migra" doesn't get involved. I had a friend who owned a trash company in California for 30 years. He got sick and tired of his worker's comp problems, so the set up a phony "labor contractor," the kind that supply workers for the farmers, and paid his trash men though the "contractor." If he got called into comp court, he said, "Oh, that's Miguels worker, I pay Miguel." "Wheres Miguel?" "Somewhere south of the border now."
