What's the point of imposing criminal non-jail sentences for, say, possessing less than an eighth of an ounce of marijuana? Deterrance and social branding. First, financial - a significant fine. Second, a criminal record. The whole point of the criminal law is to impose a social sanction - you are branded with a permanent criminal record.

For a supposedly upstanding business owner, the threat of imposing a criminal record alone may be sufficient to deter.
