Rule of law comes from the people where state creation is by the choice of the people. What came first in this case people no question of was it the chicken or the egg.

I guess that shows where rule of law comes from. It comes from what the state can get away with before the people get too unruly.



Rule of law means you aren't ruled by men, but by laws. This got people away from despotic individuals capriciously deciding who got what and political organization by the Church. The greatest addition to this idea was to democracise the law, to make all individuals subject to the same laws. The idea being that no one would want to pass an unjust law that they themselves were also subject to. The biggest problem we have here in the US is that we have increasingly passed laws that aren't blind to whom they will effect but purposely directed towards one group of individuals over another. Eventually ALL of those laws will be found to be unconstitutional.

The reason it is important to not be ruled by caprice is that it allows for economic agents to properly plan and to calculate their gains and losses.
