There should be NO reason that recruiters need to do this, if other types of business doesn't.

Sure there is -- recruiters are finding people for jobs, so you need to make sure the person is eligible for work.

As far as I know it's not illegal to represent an illegal alien in divorce court. The marriage itself isn't void.

Nor is it illegal to fill their teeth or repair their washing machines or fix their cars.
