Anything the feds (and constitution, in terms of giving power to the federal government) are silent on the states are allowed to do - UNTIL the feds preempt them. So most things are not barred in any way to begin with, but they can be barred if the feds decide after the fact it's an area they want to control.

Then the question becomes- is this a legitimate area for the Feds to interfere with state interests? And that's a question for the courts (and let's face it, state's rights are pretty much dead).
