Good question, I'd forgotten that we were talking about "retired officers". When you retire from the military you go into Fleet Reserve, anyone that's in the FR can be recalled to active duty. I vaguely remember a case were a retiree was accused of violating the Secrets Act. Instead of trying him in a civilian court they recalled him to active duty an then gave him an up close and personal with the UCMJ.
